1. Acceptance of Terms
By downloading, installing, or using TurnOver ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of Service
TurnOver is an AI-powered item identification and valuation application. The App allows users to photograph items for AI analysis, receive estimated values and descriptions, generate marketplace listings, and organize items into collections.
3. Eligibility
You must be at least 13 years old to use TurnOver. If you are under 18, you represent that you have parental consent.
4. Account Registration
You may use limited features without an account. Full features require registration. You are responsible for providing accurate information, maintaining account security, and all activity under your account.
5. AI Valuations — Important Disclaimer
For items potentially worth over $5,000, or for insurance, estate, tax, or legal purposes, we strongly recommend consulting a certified professional appraiser.
We are not liable for any decisions made based on our valuations.
6. User Content
6.1 Your Content
You retain ownership of photos and data you upload ("User Content").
6.2 License Grant
By uploading content, you grant TurnOver a non-exclusive, worldwide, royalty-free license to process photos through our AI, store and display your content to you, generate marketplace listings, and use anonymized data to improve our service. This license ends when you delete your content or account.
6.3 Prohibited Content
You agree not to upload content you don't have rights to, illegal items (stolen goods, contraband), content depicting illegal activity, or malicious files or code.
7. Acceptable Use
You agree not to reverse engineer or decompile the App, use the App for illegal purposes, attempt to gain unauthorized access, interfere with other users, use automated tools to access the service, or resell or redistribute the service.
8. Subscriptions and Payments
8.1 Free Tier
Basic features are available for free with limitations on monthly scans.
8.2 Premium Subscriptions
Billed through Apple App Store or Google Play Store. Auto-renews unless cancelled 24 hours before renewal. Prices may change with notice. No partial refunds for unused periods.
8.3 Refunds
Refund requests are handled by Apple/Google per their policies.
9. Intellectual Property
9.1 TurnOver Property
The App, including design, code, AI models, and branding, is owned by TurnOver. You receive a limited, non-transferable license to use the App.
9.2 Feedback
Any feedback or suggestions you provide may be used by us without compensation.
10. Third-Party Services
The App integrates with third-party marketplaces (eBay, Facebook, etc.). We are not responsible for third-party terms and policies, transactions on third-party platforms, or third-party service availability.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the App will be uninterrupted or error-free, that AI valuations will be accurate, that defects will be corrected, or that the App is free of harmful components.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: TurnOver shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the greater of fees paid by you in the 12 months preceding the claim, or $100 USD.
13. Indemnification
You agree to indemnify TurnOver from claims arising from your use of the App, your User Content, your violation of these Terms, or your violation of third-party rights.
14. Termination
14.1 By You
You may stop using the App at any time.
14.2 By Us
We may suspend or terminate your access for violation of these Terms, suspected fraud or abuse, or legal or regulatory reasons.
14.3 Effect of Termination
Upon termination, your license ends. We may delete your data per our Privacy Policy.
15. Dispute Resolution
15.1 Informal Resolution
Before filing a claim, you agree to contact us and attempt informal resolution.
15.2 Arbitration
Disputes shall be resolved through binding arbitration under AAA rules, except for claims in small claims court.
15.3 Class Action Waiver
You waive the right to participate in class actions.
16. General Provisions
These Terms are governed by the laws of California, USA. These Terms constitute the entire agreement. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a right doesn't waive it. We may assign these Terms; you may not.
17. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance.
